First thing I need you both to look at is your cap space and penalties. As of right now, 49ers is negative in cap space with a $5M penalty for 2014 (next season). This is not a favorable thing in my opinion. If I were to approve this trade, the 49ers would be adding another $4.1M in penalties, which will more than likely create another negative cap space situation and will force the team into either a) not being able to re-sign plauers or b) having to cut additional players. For the Giants, there is only $6.74M in cap space. If you were to trade Cruz, you would be adding another $9M in cap penalty to the already $25.8M in 2014!!!!! That is going to create an awful situation for next season and again, may limit you from a) resigning players or b) having to cut critical parts to the team.
At this point, I need to see a plan on if additional players are to be cut or how you think this will work in your favor. Think of it this way...if you were to quit the league, would the next owner want to take over this kind of situation? As of right now, unless you can give me a reason to approve this deal, I am going to say DECLINED.
